Welcome to Once Upon Tonight. These Terms of Service (“Terms”) govern your access to and use of once-upon-tonight.com and our daily bedtime story email service (the “Service”). By subscribing to or using the Service, you agree to these Terms.
1. The Service
Once Upon Tonight delivers an original bedtime story by email on a regular basis, offered in free and paid subscription tiers. Paid tiers may include additional stories, features, or content as described on our site at the time of purchase.
2. Accounts and Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create a paid subscription. The Service is intended to be used by an adult on behalf of a family, to read or play stories together with a child.
3. Subscriptions, Billing, and Cancellation
- Paid subscriptions renew automatically on the billing cycle selected at signup (e.g. monthly or annual) until cancelled.
- You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period, and you’ll retain access until then.
- Refunds: Refunds may be requested within 7 days of a charge. Charges older than 7 days are non-refundable, at our discretion.
- We may change subscription pricing with advance notice; continued use after a price change takes effect constitutes acceptance of the new price.
4. Acceptable Use
The Service and its content are for your personal, non-commercial, family use. You agree not to:
- Copy, redistribute, resell, or publicly republish story content without our written permission
- Use the Service in any way that violates applicable law
- Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service
5. Intellectual Property
All stories, text, illustrations (where applicable), and other content delivered through the Service are owned by Once Upon Tonight or its licensors and protected by copyright and other intellectual property laws. Subscribing to the Service grants you a limited, non-exclusive, non-transferable license to access and enjoy the content for personal family use. This license does not include the right to reproduce, distribute, publicly perform, or create derivative works from our content.
6. Content Disclaimer
Once Upon Tonight’s stories are provided for entertainment purposes. They are not intended as educational curriculum, therapeutic content, or medical, developmental, or psychological advice. Use your own judgment about what’s appropriate for your child.
7. Third-Party Services
The Service relies on third-party providers, including WordPress.com/Jetpack for hosting and email delivery and Stripe for payment processing. Your use of those providers’ functionality is also subject to their own terms.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the Service will be uninterrupted, timely, or error-free.
9. Limitation of Liability
To the maximum extent permitted by law, Once Upon Tonight and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim.
10. Changes to the Service or These Terms
We may modify or discontinue features of the Service, and may update these Terms from time to time. We’ll update the “Last updated” date above, and for material changes we’ll make a reasonable effort to notify subscribers by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles, and any disputes will be resolved in the courts located in Utah.
